The document, written by Justice Samuel Alito, states “Roe was egregiously wrong from the start. Its reasoning was exceptionally weak, and the decision has had damaging consequences. And far from bringing about a national settlement of the abortion issue, Roe and Casey have enflamed debate and deepened division.”. The conservative-appointed majority court is currently voting five to the three democratic-appointed judges.
While a final decision is yet to be published by the court, which may not arrive for two months or more, the document demonstrates the fears of many over the fate of Roe v Wade and abortion rights in the United States. If the court overrules the 1973 court decision, it would leave abortion laws up to the determination by each individual state. Many believed the court would remove aspects of abortion rights or limit Roe v Wade, but now are shocked that the court is intending to completely overturn the decision.
